SEATTLE (Scrap Monster): On November 17, 2023, the U.S. International Trade Commission (USITC) preliminarily decided that the accused imports injure or threaten to injury a domestic industry as to all accused countries except the Dominican Republic (DR). See Aluminum Extrusions from China, Colombia, Dominican Republic, Ecuador, India, Indonesia, Italy, Malaysia, Mexico, South Korea, Taiwan, Thailand, Turkey, United Arab Emirates, and Vietnam. ITC said DR imports negligible – i.e., under 3% of total subject imports. The trade remedy – i.e., antidumping (AD)/ countervailing duty (CVD) — investigation thus ends now as to DR, and continues for all other accused countries.
It seems that imports from all other accused countries were each over 3% of total imports, as otherwise they would have been negligible and excluded too. And if imports from another accused country were also under 3% of total imports, then ITC would have looked at whether accused countries with imports each under 3% were together over 7% and then not excluded as negligible. The ITC based these determines on responses to USITC importer questionnaires.
The USITC written explanation of its above decision is out December 26, 2023. That written decision will provide full explanation, including any USITC concerns to be addressed latter in the more rigorous final USITC injury investigation as to whether accused imports are a cause (or threat) of material injury to a U.S. industry such that AD/CVD import duties found by the U.S. Department of Commerce (DOC) should be imposed as a final matter.
