AISI Applauds Court Ruling Upholding Section 232 Tariffs

SEATTLE (Scrap Monster): The American Iron and Steel Institute (AISI) welcomed the decision by the Court of Appeals for the Federal Circuit to uphold the constitutionality of the Section 232 tariffs imposed by the U.S. administration.

In a statement, Thomas J. Gibson, president and CEO, AISI noted that the Court of Appeals ruling rightly affirmed its strong belief and the previous decision of the Court of International Trade that the constitutional challenge to the Section 232 statute is without merit. The lawsuit by the steel importers is a weak attempt to mask the bad implications of surging foreign imports on domestic steel industry and the threats posed to national and economic security of the country. The Court ruling affirms that Congress acted within its constitutional authority by authorizing the President to take necessary action, the statement said.

The Appeals Court had denied an appeal filed by U.S. steel importers challenging the constitutional authority of the Section 232 metals tariffs. In doing so, the Court upheld the decision taken by the U.S. Court of International Trade in March last year. The lawsuit was filed by the American Institute for International Steel (AIIS) along with two of its members in June 2018.
