1,)What is it about?
Legal position / initial situation
The national implementation of the European Directive on waste electrical and electronic equipment is the law on the placing on the market, return and environmentally friendly disposal of electrical and electronic equipment (Electrical and Electronic Equipment Act - ElektroG) of October 20, 2015. This law is published on October 23 in the Federal Law Gazette Year 2015 Part 1 No. 40 and thus obliges the manufacturers / importers of gas discharge lamps, energy saving lamps and others (LED retrofit lamps) to organize and finance the separate collection and treatment of old lamps.
2.) Who is affected?
Manufacturers and importers are on an equal footing. Manufacturer in the sense of the new ElektroG is everyone who
who manufactures gas discharge lamps, energy saving lamps and others (LED retrofit lamps) under his name and puts them on the market for the first time,
who manufactures gas discharge lamps, energy saving lamps and others (LED retrofit lamps) under his name and puts them on the market for the first time,
Vendors who resell under their brand names,
Importers who import gas discharge lamps, energy saving lamps and others (LED retrofit lamps) and place them on the market,
Exporters who export and sell directly to a user in a member state of the European Union,
Distributor if he culpably offers new gas discharge lamps, energy saving lamps and others (LED retrofit lamps) from non-registered manufacturers for sale.
3.) What do manufacturers / importers have to do according to ElektroG?
The manufacturers / importers have the following obligations:
Registration with the stiftung ear (stiftung elektro-old equipment register) for the relevant types of equipment
Mention of the registration number of stiftung ear in the business papers
Proof of an insolvency-proof guarantee according to § 7 (2) for "new old lamps"
Monthly notification of the gas discharge lamps, energy-saving lamps and other (LED retrofit lamps) placed on the market to stiftung ear
Receipt and fulfillment of the collection orders for the örE (public waste disposal authority) from stiftung ear
Confirmation of the collection from the örE and the otherwise collected and recycled old lamps
Marking of the gas discharge lamps, energy-saving lamps and others (LED retrofit lamps) placed on the market with the prescribed symbol (barrel plus bar)
Creation of a return point for other than private users in a reasonable distance
Manufacturers / importers can use reliable third parties to fulfill these legal obligations.
4.) What is Lampen-Recycling und Service GmbH (LARS)?
In order to largely relieve all manufacturers / importers in Germany, the leading suppliers of gas discharge lamps, energy-saving lamps and other (LED retrofit lamps) have set up disposal systems. The LARS system is run by large domestic manufacturers and is open to all other manufacturers / importers in Germany without discrimination. LARS is an independent service provider for manufacturers / importers of lamps to fulfill their obligations under the new ElektroG and offers all participants its comprehensive services at uniform conditions.
5.) What does LARS offer?
As an independent service provider, LARS offers a manufacturer / import-oriented overall solution with which manufacturers / importers can meet their obligations under the ElektroG. All participants benefit from the quantitative advantages achieved for this. The following services are offered:
Processing and financing
Forwarding of the necessary reports to stiftung ear
Establishment of suitable collection points at reasonable distances across Germany
Collection of the old lamps from the örE`s and the other collection points
Treatment, recycling and environmentally friendly disposal of old lamps
Best prices through bundled quantities
Mediation of participation in a collective guarantee system within the meaning of Section 7 (2) ElektroG 6.)
6. What do manufacturers / importers have to do in order to benefit from the advantages of the LARS system?
Registration with stiftung ear
Conclusion of a service contract with LARS.
Conclusion of a guarantee contract with Elektro-Altgeräte Garantie GmbH with limited liability. (EAG)
Reporting of the quantities and weights of gas discharge lamps and other (LED retrofit lamps) placed on the market in the LARS system (for forwarding to stiftung ear).
Providing a bank guarantee to secure advance payments from LARS (not applicable if you participate in the EAG guarantee system)
Fee for expenses by LARS, calculated for each lamp sold (currently 0.13 € per gas discharge lamp and from 01.10.2017 0.08 € per LED retrofit lamp)
