ATO Ragusa Environment SpA . was established in December 2002 in accordance with the provisions of the so-called Ronchi Decree (Legislative Decree 5 February 1997 n° 22, article 23). The Ronchi Decree and the subsequent Legislative Decree no. 152/2006 (Consolidated Law on the Environment) attribute to the Company the role of Area Authority for the implementation of the Integrated Waste Cycle in the Optimal Territorial Area (ATO) called ATO RG 1, which includes the twelve municipalities of the Province of Ragusa: Acate, Chiaramonte Gulfi, Comiso, Giarratana, Ispica, Modica, Monterosso Almo, Pozzallo, Ragusa, Santa Croce Camerina, Scicli, Vittoria. The corporate structure also includes the Regional Province of Ragusa.
ATO Ragusa Ambiente SpA was placed into liquidation in May 2010 following LR no. 9/2010 which provided for the establishment of the new Waste Regulatory Companies (SRR).
The Company, until it was put into liquidation (May 2010, following LR no. 9/2010), had as its object the integrated management of waste in the ATO, in compliance with the legislation in force at the time, on the basis of a management plan scope, according to criteria of efficiency, effectiveness and cost-effectiveness in the optimal territorial context (ATO), in compliance with European Union directives and national and regional regulatory provisions on waste, as well as the creation of an integrated verification system concerning the payment of the waste tax and the correct management of the tariff system, including the transition period from the TARSU to the tariff, with particular reference to the elimination of evasion,in order to allow a more equitable distribution and total coverage of the costs of integrated and integral management of the waste cycle, in compliance with current regulations.
The Company has ensured, although in liquidation, the continuity of the essential public service of urban solid waste management within its area of competence until 09.30.2013.
Instead, starting from 01.10.2013, in consideration of the prohibition for the Area Company in liquidation to implement management actions (art. 19, paragraph 2 bis, LR no. 9/2010), the continuity of the services managed by the ATO Ragusa Ambiente SpA in liquidation was guaranteed by an Extraordinary Commissioner appointed by the Sicilian Region following contingent and urgent Orders of the President of the Sicilian Region and, subsequently, by a Commissioner appointed by Order of the Extraordinary Commissioner of the Free Municipal Consortium of Ragusa .
