Lawsuit Alleges Weyerhaeuser of Withholding Evidence in Workplace Injury Case
The company refused to produce the investigative incident report before the Superior Court judge, despite court order.
SEATTLE (Scrap Monster): The lawsuit filed in Los Angeles Superior Court alleges that Weyerhaeuser has been responsible for creation of unsafe working condition that led to severe injuries for a truck driver at its Santa Clarita facility. Furthermore, the lawsuit also accused the company for attempting to suppress the evidence, by refusing to provide security camera footage.
The incident took place in October 2015, when Peter Alfaro attempted to secure lumber load for transportation. The entire freight fell upon him, crushing him to the ground, thereby resulting in serious injuries. The employee was trapped in lumber for almost an hour, before he was finally discovered. Peter is currently undergoing medical treatment, which needs to be continued throughout his life time.
The company refused to produce the investigative incident report before the Superior Court judge, despite court order. Instead Weyerhaeuser filed a petition claiming that the incident report contained privileged information which could not be revealed before court. Further, the company claimed that the security cameras did not pick up the incident, despite the fact that cameras were in working condition during the time of the incident.
According to attorney Khail A.Parris, Weyerhaeuser has not taken any productive steps to find out how the injuries could have been avoided. In addition, the company’s attempts to withhold evidence places undue burden on the affected employee, he noted.
